Terms and Conditions for Chilliwack Pharmacy App and Website

1. Acceptance of Terms
By accessing or using the Chilliwack Pharmacy website, mobile app, online refill services, consultation request services, transfer request services, delivery request services, or any related online services collectively referred to as the “Service,” you agree to comply with and be bound by these Terms and Conditions.
If you do not agree with these Terms and Conditions, please do not use the Service.
2. About Chilliwack Pharmacy
Chilliwack Pharmacy is a licensed community pharmacy located in British Columbia, Canada. Pharmacy services are provided in accordance with applicable federal and provincial laws, the requirements of the College of Pharmacists of British Columbia, and applicable professional standards.
The Service is intended to support pharmacy-related services, including prescription refill requests, prescription transfer requests, communication with the pharmacy, delivery coordination, and access to certain healthcare or consultation-related services where available.
The Service does not replace professional medical advice, diagnosis, treatment, emergency care, or direct communication with a licensed healthcare professional.
3. Jurisdiction and Service Availability
The Service is intended for patients located in jurisdictions where Chilliwack Pharmacy and any participating healthcare providers are legally permitted to provide pharmacy, consultation, prescription, delivery, or related healthcare services.
Services may be limited based on patient location, licensing requirements, clinical appropriateness, medication type, prescriber authority, delivery area, inventory availability, and applicable law.
4. Not for Emergencies
The Service is not intended for medical emergencies or urgent medical concerns.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency department. If you require urgent medical advice, contact a physician, pharmacist, nurse, or other qualified healthcare provider directly.
Do not rely on website forms, app messages, refill requests, or online consultation requests for urgent or emergency medical situations.
5. Changes to Terms
Chilliwack Pharmacy may modify these Terms and Conditions at any time. Any changes will become effective when posted on our website or app.
Your continued use of the Service after changes are posted means that you accept the updated Terms and Conditions.
6. Privacy and Protection of Health Information
Your use of the Service is also governed by our Privacy Policy, which explains how Chilliwack Pharmacy collects, uses, discloses, stores, and protects personal information, personal health information, prescription records, and pharmacy records.

Chilliwack Pharmacy may suspend or restrict access to an account if we believe there has been misuse, unauthorized access, inaccurate information, privacy risk, safety concern, or violation of these Terms and Conditions.
9. Minors and Family Accounts
Individuals under the age of 16 may not create independent accounts through the Service.
A parent or legal guardian may request to add a minor as a family member under their account, subject to pharmacy approval and verification.
Chilliwack Pharmacy may request information or documentation to confirm the parent/legal guardian relationship before allowing access to a minor’s profile or prescription-related information.
The parent or legal guardian is responsible for the use of the Service on behalf of the minor, including prescription refill requests, order placement, communication with the pharmacy, and privacy of the minor’s health information.
Chilliwack Pharmacy may deny, suspend, or revoke access to a minor’s information if we are unable to verify authority, if access may not be appropriate, or if we believe it is necessary to protect the minor’s health, safety, or privacy.
10. Prescription Refills, Transfers, and Pharmacy Services
The Service may allow users to request prescription refills, prescription transfers, delivery, medication reviews, consultations, or other pharmacy services.
All requests are subject to review and approval by Chilliwack Pharmacy and/or the appropriate licensed healthcare professional.
By submitting a request, you acknowledge and agree that:

11. Valid Prescription Required
Chilliwack Pharmacy dispenses prescription medications only pursuant to a valid prescription issued by an authorized prescriber, where required by applicable law.
Submission of a refill request, transfer request, online form, or consultation request does not guarantee that a prescription will be issued, filled, refilled, transferred, or delivered.
All prescription requests are subject to pharmacist review, legal requirements, clinical appropriateness, prescriber authorization, patient eligibility, and medication availability.
12. Online Consultation Services
The Service may allow users to request or access online consultations with licensed healthcare providers where available.
Chilliwack Pharmacy may facilitate access to consultation services, but Chilliwack Pharmacy does not itself provide physician services unless specifically stated.
By using consultation-related services, you acknowledge and agree that:

14. Delivery and Pickup
Where delivery or pickup services are available, they may be subject to pharmacy approval, geographic limits, delivery schedules, patient eligibility, payment status, medication type, legal restrictions, and professional requirements.
Delivery times are estimates only and are not guaranteed.
Certain medications or services may require identity verification, direct patient counselling, signature, temperature control, or other safeguards before release.
15. Payment, Pricing, and Insurance
Medication prices, service fees, delivery fees, insurance coverage, and third-party billing results may vary.
Any pricing shown through the website, app, or communication with the pharmacy is subject to confirmation, insurance adjudication, applicable fees, inventory, and pharmacist review.
Patients are responsible for any copayments, deductibles, non-covered items, delivery fees, or other amounts not paid by public or private insurance plans.
16. Right to Refuse or Cancel Service
Chilliwack Pharmacy reserves the right to refuse, cancel, delay, or modify any request, order, refill, consultation-related request, delivery, or service where we determine it is necessary or appropriate for legal, clinical, professional, safety, privacy, inventory, payment, or operational reasons.
This may include situations involving inaccurate information, suspected misuse, safety concerns, inappropriate medication requests, inability to verify identity or authority, prescriber refusal, insurance issues, or failure to comply with these Terms and Conditions.
17. Third-Party Services
The Service may rely on third-party providers for website hosting, app functionality, cloud storage, communications, payment processing, appointment booking, online consultations, analytics, delivery coordination, or other operational support.
Chilliwack Pharmacy takes reasonable steps to work with reputable service providers, but we are not responsible for interruptions, outages, delays, errors, or failures caused by third-party systems outside our direct control.
Use of third-party services may also be subject to the third party’s own terms and privacy practices.
18. Service Availability and Technical Issues
Chilliwack Pharmacy does not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
The Service may be unavailable or limited due to maintenance, technical issues, internet outages, system failures, cybersecurity events, third-party service interruptions, or events beyond our reasonable control.
Chilliwack Pharmacy is not responsible for any loss, delay, inconvenience, or inability to access the Service due to factors outside our reasonable control.

Chilliwack Pharmacy uses reasonable safeguards to protect the Service and patient information. However, no electronic system, website, app, or method of transmission is completely secure.
You are responsible for using secure devices, protecting your passwords, avoiding public or shared devices when accessing health information, and notifying us promptly if you believe your account or information has been compromised.

Nothing in these Terms and Conditions limits liability that cannot legally be limited under applicable law.
22. Indemnification
You agree to indemnify, defend, and hold harmless Chilliwack Pharmacy, its owners, directors, employees, contractors, affiliates, and service providers from any claims, damages, liabilities, losses, costs, or expenses arising from:

Chilliwack Pharmacy will not be responsible for any delay or failure to perform obligations caused by events beyond our reasonable control, including natural disasters, fire, flood, power failure, internet outage, cyberattack, labour disruption, government action, public health emergency, supply shortage, transportation disruption, third-party system failure, or other events outside our reasonable control.
24. Governing Law
These Terms and Conditions are governed by the laws of British Columbia and the applicable laws of Canada.
Any disputes arising from these Terms and Conditions or use of the Service will be subject to the courts of British Columbia, Canada, unless otherwise required by applicable law.
