Acceptance of Terms By accessing or using the Chilliwack Pharmacy app and website (collectively referred to as "the Service"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

Changes to Terms We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our app or website. Your continued use of the Service after any changes constitutes your acceptance of the new terms.

Minors and Family Accounts: No Direct Accounts for Minors: Individuals under the age of 16 are prohibited from creating independent accounts on this pharmacy application. Parental/Legal Guardian Access: Parents or legal guardians of minor clients may add their minor children as family members to their existing accounts. Verification of Relationship: To add a minor as a family member, the parent or legal guardian must provide documentation and information satisfactory to the pharmacy to verify their relationship with the minor. The pharmacy reserves the right to request and verify this information before granting access. Parental Responsibility: The parent or legal guardian assumes full responsibility for the minor's use of the app, including but not limited to prescription management, order placement, and adherence to these Terms and Conditions. Pharmacy Approval: The addition of a minor to a family account is subject to approval by the pharmacy. The pharmacy may deny or revoke access if it determines that the relationship is not adequately verified or if it is in the best interest of the minor's health and safety. Data Privacy: The parent or legal guardian acknowledges and agrees that they are responsible for managing the privacy of the minor's health information accessed through the family account, in accordance with applicable privacy laws and our Privacy Policy."

Use of the Service You agree to use the Service only for lawful purposes and in accordance with these terms. You agree not to: Use the Service in any way that violates any applicable federal, state, local, or international law or regulation. Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service. Impersonate or attempt to impersonate Chilliwack Pharmacy, a Chilliwack Pharmacy employee, another user, or any other person or entity.

User Accounts To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account.

Prescription Refills and Consultations The Service allows users to request prescription refills and online consultations with licensed healthcare providers. All requests are subject to review and approval by qualified professionals. By using this feature, you acknowledge that: You provide accurate and complete information regarding your medical history and prescriptions. Chilliwack Pharmacy does not guarantee the availability of any prescription or medical consultation.

Online Physician Consultations Disclaimer Chilliwack Pharmacy acts solely as a facilitator to connect users with licensed healthcare professionals for online consultations. We do not provide medical advice, diagnosis, or treatment. Chilliwack Pharmacy is not liable for any decisions made, actions taken, or consequences arising from the interactions between users and physicians. You acknowledge that the responsibility for any medical decisions or care rests solely with the healthcare provider.

Intellectual Property All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of Chilliwack Pharmacy or its licensors and are protected by applicable intellectual property laws.

Limitation of Liability To the fullest extent permitted by law, Chilliwack Pharmacy will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. This includes, but is not limited to, damages for loss of profits, goodwill, or data.

Indemnification You agree to indemnify, defend, and hold harmless Chilliwack Pharmacy, its affiliates, and its employees from any claims, liabilities, damages, costs, or expenses (including reasonable attorney fees) arising out of your use of the Service or your violation of these Terms and Conditions.

Service Availability, Force Majeure, and Security (a) Third-Party Services: Chilliwack Pharmacy utilizes third-party cloud services (the "Third-Party Services") for certain Software functionalities, including data storage, hosting, and delivery. While Chilliwack Pharmacy selects reputable providers and takes reasonable measures to ensure reliability, it is not responsible for the performance or availability of these Third-Party Services. Interruptions, outages, or errors caused by these services are outside Chilliwack Pharmacy's direct control. (b) Force Majeure: Neither party is liable for any failure or delay in performing its obligations under these Terms to the extent caused by events beyond its reasonable control, including acts of God; war; terrorism; riots; embargos; acts of civil or military authorities; fire; floods; accidents; strikes; or shortages of transportation, facilities, fuel, energy, or materials. This includes disruptions or unavailability of Third-Party Services. (c) Cyberattacks: Chilliwack Pharmacy implements reasonable security measures to protect the Software and data from cyberattacks. However, Chilliwack Pharmacy is not liable for any damages, losses, or liabilities arising from cyberattacks (including distributed denial-of-service attacks, malware infections, data breaches, or unauthorized access) unless directly caused by Chilliwack Pharmacy's gross negligence or willful misconduct. The pharmacy is responsible for implementing and maintaining appropriate security measures to protect its own systems and data.

Governing Law These Terms and Conditions are governed by the laws of British Columbia, Canada. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada
